Unfair Letting Agency Hidden Repeat Renewal Fees

I had this interesting email from a Denise C

“You were very helpful earlier in the year when I ran into difficulties, alerting me to the OFT (Office of Fair Trading) v Foxtons ruling (Lord Justice Mann’s Ruling) and guiding me to the NLA helpline.

I am filling you in now as to the successful – as it may be helpful for your book/blog:

I did refuse to pay these fees after one year, writing to the Estate Agent and letting them know, citing the OFT ruling. In a series of three letters they ignored what I said and arguing they had made it clear since it was in bold (tho in small print). Finally I got a letter threatening legal action and the risk of cost against me.

Then I found CAB (Citizens Advice Bureau) help, who alerted me to the RICS (Royal Institution of Chartered Surveyors) website. They say that a senior manager has to respond to a complaint and if this does not resolve it, then the complaint should go to the Ombudsman. I wrote again re-stating my central points and asking that they now send it to the Ombudsman. Only then did they back down.

So stressful and worrying at the time. But good to know that there is this mechanism that protects the small landlord v the Estate Agents.

I have also asked that the NLA push it as an issue and also the CMA. Whether either of them will take it up remains to be seen. But I thought it might help your readers to know.Very best,
